Bigfoot Desert Adventure UTV Tours – Terms & Conditions

1. Acceptance of Terms
By booking, participating in, or attending any tour operated by Bigfoot Desert Adventure UTV Tours, all participants acknowledge that they have read, understood, and agreed to these Terms & Conditions.
2. Eligibility Requirements
- Drivers must be at least 21 years old and possess a valid driver’s license.
- Passengers under 18 years old must be accompanied by a parent or legal guardian.
- All participants must follow the instructions provided by guides and staff at all times.
- Bigfoot Desert Adventure reserves the right to refuse participation to any individual who appears intoxicated, impaired, reckless, or unable to safely participate.
3. Assumption of Risk
Off-road UTV tours involve inherent risks, including but not limited to:
- Uneven terrain
- Sudden movements or impacts
- Dust, rocks, and desert wildlife
- Weather conditions
- Vehicle rollover or collision
By participating, guests voluntarily assume all risks associated with off-road activities.
4. Liability Waiver
Participants release and hold harmless Bigfoot Desert Adventure UTV Tours, its owners, employees, guides, contractors, and affiliates from any liability for injuries, damages, losses, accidents, delays, or property damage arising from participation in the tour, except where prohibited by law.
5. Safety Requirements
- Seat belts must be worn at all times.
- Helmets and protective equipment provided by Bigfoot Desert Adventure must be properly used when required.
- Reckless driving, racing, drifting, donuts, excessive speeding, or unsafe behavior are strictly prohibited.
- Guests must remain on designated trails and follow guide instructions at all times.
- Alcohol, illegal drugs, or impairment of any kind are strictly prohibited before or during the tour.
Failure to comply with safety rules may result in immediate termination of the tour without refund.
6. Damage Responsibility
Guests are financially responsible for any damages caused to vehicles, equipment, or property resulting from negligence, reckless behavior, failure to follow instructions, or violation of these Terms & Conditions.
7. Weather & Environmental Conditions
Tours operate in most weather conditions. Bigfoot Desert Adventure reserves the right to modify, delay, reschedule, or cancel tours due to unsafe weather, trail conditions, mechanical issues, or safety concerns.
8. Booking & Payment Policy
- Full payment may be required at the time of booking.
- Reservations are not guaranteed until payment is received.
- Prices are subject to change without notice.
- Promotional discounts and coupon codes cannot be combined unless otherwise stated.
9. Cancellation & Refund Policy
- Cancellations or rescheduling are possible more than 48 hours before the scheduled tour.
- Cancellations less than 48 hours before the scheduled tour are non-refundable.
- No-shows are non-refundable.
- Refunds may exclude payment processing fees, including Square.
- Guests who wish to reschedule must contact Bigfoot Desert Adventure as soon as possible. Rescheduling requests are subject to availability.
- Bigfoot Desert Adventure reserves the right to cancel, modify, or reschedule tours due to weather conditions, safety concerns, trail conditions, mechanical issues, or unforeseen operational circumstances.
- In the event that Bigfoot Desert Adventure cancels a tour, guests may be offered a rescheduled date or a refund at the company’s discretion.
10. Arrival Policy
Guests are required to arrive at least 15 minutes before the scheduled tour departure time.
Late arrivals may result in cancellation without refund.
11. Photography & Media Release
By participating in the tour, guests grant Bigfoot Desert Adventure permission to use photographs and videos taken during the experience for promotional, advertising, social media, and marketing purposes without compensation.
Guests who do not wish to appear in promotional materials must notify staff before the tour begins.
12. Personal Property
Bigfoot Desert Adventure is not responsible for lost, stolen, or damaged personal belongings.
13. Medical Conditions
Participants are responsible for determining whether they are physically capable of participating.
Guests who are pregnant or who have medical conditions that may be aggravated by off-road activity should consult a physician before participating.
14. Indemnification
Participants agree to indemnify and hold harmless Bigfoot Desert Adventure UTV Tours from any claims, demands, actions, liabilities, damages, or expenses arising from their participation or conduct.
15. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Arizona.
